Important Information for our members who are making either a Personal Injury or potential Clinical Negligence Claim.

How it works

In the unfortunate event where you’ve been involved in an incident that wasn’t your fault, you may decide to pursue a legal claim against the negligent third party. 

In such circumstances, it’s important that you inform us of the claim, as the terms of your membership with AXA Health include an obligation to include any medical expenses paid for as result of the incident within your claim. Please see below copies of the standard handbook wording our insured plans and Trust schemes for reference.  


Your responsibility

It is your responsibility to inform us if you’re making a personal injury claim. We may have already attempted to contact you by either sending an Injury Information Form or by asking the solicitors we work with (DMH Stallard LLP) to speak with you. Alternatively, you can advise us directly by completing the form below. 

Once we’ve been made aware of your case, we will support you by liaising with your legal representative directly and advising them of the costs to include within your claim.

Insured Policies - Subrogation Law Explained

We use the law of subrogation to seek recovery of any related treatment costs.

Subrogation is the legal right of an insurer to claim back costs from a third party that caused the accident/incident.

You must let us know if you have registered a claim with us or if any of the treatment covered by your membership is as a result of an accident caused by a third party. You can do this by completing the Injury Information Form already sent to you, by speaking with DMH Stallard LLP or by completing the form below if you’ve found representation. 

No, your membership does not include any provision for legal expenses. However, you may have this benefit included in other policies such as your home, travel or motor insurance and we recommend you contact a legal expert for advice on your situation.
