Terms and Conditions

The promoter of the prize draw is AXA PPP Healthcare Group Limited (registered number 03148346), whose registered office is at 20 Gracechurch Street, London EC3V 0BG, (“we” “us” or the “Promoter”). “AXA Group” means AXA UK plc (registered number 02937724) and its direct and indirect subsidiary companies, any holding company of AXA UK plc and any subsidiary companies of such holding company, as such terms are defined in section 1159 of the Companies Act 2006.

Eligibility and Entering the Prize Draw

  1. The Promoter shall lead and administer the prize draw via its telephone marketing channel.
  2. To enter the prize draw, an entrant must:

2.1    purchase a Business Healthcare Plan (“Plan”) directly from AXA Group (not via a broker);

2.2    purchase the Plan between the period of 6 January 2025 and 28 February 2025; and

2.3    not cancel the Plan within the 14-day ‘cooling off period’.

 Any entrant complying with the conditions in this Clause 2, will be an “Eligible Entrant” and automatically be entered into the prize draw. For the avoidance of doubt, existing customers of the AXA Group who renew their Plan are not eligible.  

3  Eligibility of entrants will be decided by the Promoter whose decision shall be final and binding. The Promoter reserves the right to verify the eligibility of all entrants and has the right to reject any entries that appear to be duplicates, materially incorrect or fraudulent. The prize draw is not available to employees of any companies within the AXA Group or their associates, affiliated or subsidiary companies, or their families, agents, appointed representatives or anyone connected or involved in the administration of the prize draw.

4  Entries are limited to one entry per Eligible Entrant.

5  At any point during the Prize Draw Period, if you would like to withdraw from the prize draw, you may do so at any time by contacting the Promoter at smesales@axahealth.co.uk.  

Prize Draw Information  

6 The Winner shall receive an amount equal to its first year’s annual premium for the purchased Plan (the “Prize”). The Prize shall not exceed an amount of £10,000 including any applicable tax.  

7 If the Winner has paid the annual premium of the Plan up front in one lump sum, subject to clause 6 above, the Promoter will refund the Winner an amount equal to its first year’s annual premium in one lump sum. The refund will be paid to the bank account that purchased the Plan.

8 If the Winner is paying for the Plan in monthly instalments, they will receive a refund in respect of those instalments that have already been paid. The refund will be paid to the bank account that purchased the plan. Subject to clause 6, the balance of the Prize will be set-off against the remaining unpaid monthly instalments of the respective Plan.

9 If the Winner’s annual premium for its purchased Plan exceeds £10,000, the Winner will receive the Prize at the maximum amount of £10,000 in accordance with clause(s) 7 and 8 above and shall pay any shortfall between the remaining amount of their annual premium of their Plan and the Prize.

11 Any Plan purchased before or after the Prize Draw Period, will not be eligible for participation in the Prize Draw.

Winning and Claiming the Prize

12  There will only be one winner for this prize draw (the “Winner”).

13  At the end of the Prize Draw Period, the Promoter will select the Winner via an independently verified Prize Draw selection process or a random number generator.

14 The Promoter’s decision is final and binding.

15 The Prize is not transferable and is for use by the Winner only. There is no cash alternative.

16 The Promoter reserves the right to substitute a prize for one of greater or equal value.

17 The Prize cannot be applied to any additional amounts payable due to the Winner making changes to their Plan or purchasing extra cover or products once they have been announced as the Winner. Accordingly, the Winner will be responsible for paying any additional premium that is due on the Plan, once announced as the Winner.

18 The Promoter is not responsible if the Winner is unable to accept the Prize or does not use the Prize for any reason whatsoever and no alternative prizes are offered.

Winner Notification

19 The Promoter shall contact the Winner via email and/or telephone within 7 working days of the end of the Prize Draw Period and arrange for the Prize to be administered to the Winner within 14 working days after contact is successfully made with the Winner.  

20  No more than three attempts will be made to contact the Winner.

21 If the Promoter does not have a response from the Winner or cannot contact the Winner within 10 working days of the date upon which the Promoter first contacted the Winner, the Promoter shall be entitled to select a new Winner and the same acceptance and contact period shall apply.

22 You will not be notified if you do not win the prize draw.

General Terms

24 By participating in the prize draw, you agree to be fully bound by these terms and conditions and those of any relevant third party and by any other requirements set out in any related promotional material. In the event of a conflict, these terms and conditions take precedence. If you do not comply with these terms and conditions, your participation in the prize draw will be revoked and you will be disqualified.

25 The Promoter accepts no responsibility for entries not successfully entered due to a technical fault, network or server failure of any kind.

26 The Promoter reserves the right to withdraw or amend the prize draw or these terms and conditions at any time on reasonable notice. The Promoter also reserves the right to delay or postpone the prize draw at its sole and absolute discretion.

27 The Winner consents to the use of their name, company name, trading name and home town/city to be used by the Promoter and its associated companies during the Prize Draw Period and for post-event publicity purposes (including but not limited to publishing on its relevant social media accounts and in the media) and will co-operate with any other reasonable requests by the Promoter relating to any publicity unless otherwise stated in advance to the Promoter.

28 The Winner may be required to take part in publicity related to the prize draw.

29 The Prize may be liable to tax. Any tax liability shall be the responsibility of the Winner.

30 By taking part in the prize draw, you agree that the Promoter is not liable for any loss, damage, disappointment or personal injury whatsoever suffered or sustained by you in connection with the prize draw(including but not limited to direct, indirect or consequential losses, loss of profit, income or goodwill), the use of any prize, or any act or omission (whether negligent or not) of the Promoter or its affiliates, save for any liability which cannot be excluded by law (including fraud, gross negligence or for death or personal injury caused by the Promoter’s or its affiliates’ negligence).

31 If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

32 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

Data Protection

1.“Personal data” and “processing” shall have the meanings set out in the General Data Protection Regulation (“GDPR”). Any reference to personal data includes a reference to sensitive personal data, as applicable, whereby sensitive personal data means personal data that incorporates such categories of data as are listed in Article 9(1) of the GDPR.

2. By entering the prize draw, the entrants agree that the Promoter may collect personal data from the entrants, including for the avoidance of doubt, the information submitted by the entrants when they purchase a Plan and consent to the use of their personal information for the purposes specified in these terms and conditions.

3. Each entrant agrees that the Promoter may only use their personal data in connection with the prize draw for the following purposes:

  1. to administer the prize draw in accordance with these terms and conditions;
  2. to notify the Winner that they have won the prize draw; and
  3. for post-event publicity purposes including but not limited to announcing the Winner on AXA Group’s social media accounts or company website.

Personal data of each entrant shall not be used by the Promoter for any other purpose other than those listed above.  We will not use your personal data to contact you about AXA Group products or services. 

4. Personal data shall be destroyed and/or deleted after the prize draw unless otherwise agreed between the Promoter and the entrant. 

5. You can withdraw your entry for the prize draw/competition at any time by writing to the Promoter at AXA PPP healthcare Group Limited, International House, Forest Road, Tunbridge Wells TN2 5AL.

6. You can change your mind and/or request for your personal data in relation to the prize draw to be destroyed and/or deleted at any time by writing to the SME Sales Team at smesales@axahealth.co.uk

7. The Promoter shall comply with its obligations under the Data Protection Act 2018 and the GDPR.
